That is what the newly minted CID director Shuhaily Zain is alleging. A figment of his imagination?

Press Statement by the Family of Teoh Beng Hock
Issued in Kuala Lumpur on 16 April 2025
The family of Teoh Beng Hock expresses our strongest objection and protest against the allegations made by Bukit Aman CID Director Comm. Suhaily in yesterday's media reports. He claimed that our family's lack of cooperation in the re-investigation has hindered police efforts. We categorically reject this entirely unfounded, unreasonable and malicious accusation, which is clearly intended to mislead the public, distort the truth and shift blame away from the authorities.
The Kuala Lumpur High Court has expressly ordered the police to complete their investigation within six months from 21 November 2024 into the six previous re-investigations conducted over the past 16 years regarding Beng Hock's wrongful death. This judicial directive was issued precisely because the police investigation reports remained incomplete and unsatisfactory, failing to provide our family and the deceased with justice. The court has mandated that the police must resolve all outstanding questions raised in the judicial review and finalize the pending investigative findings within this timeframe.
We condemn the police for slandering our family with false claims of non-cooperation to cover up the consequences of their fundamental error in applying Section 342 (Wrongful Confinement) of the Penal Code instead of treating this as a murder case. This is nothing but a shameful attempt to evade responsibility. Our position is based on the following facts:
1. This judicial review encompasses all investigations conducted over the past 16 years
It is public knowledge that our family has undergone multiple interrogations including:
- Questioning at Kajang police station
- Pre-autopsy examinations by forensic pathologists
- Repeated court testimonies under oath
- Psychological evaluations by government-appointed experts
All statements, testimonies and investigation reports are already documented. The police can access these records anytime. Director Suhaily - what further cooperation do you require from us? With six police investigations conducted over 16 years, why is our "lack of cooperation" only being raised now as an excuse?
2. The evidence and facts of homicide are incontrovertible
Have the police thoroughly examined the Court of Appeal's landmark judgment dated 5 September 2014? The appellate court overturned the coroner's "open verdict", conclusively ruling out suicide or accident. Three judges unanimously determined that Beng Hock was killed by one or more persons, including MACC officers involved in his detention.
Our family wasn't present at the crime scene. How exactly are we supposed to help police apprehend the killers? We pursued this judicial review precisely to demand that the police provide answers to the public - who killed Beng Hock and who must be held accountable? Now the police expect us to provide these answers instead?
3. Autopsy report proves Beng Hock was severely injured before death
The forensic report confirms Beng Hock sustained fatal neck injuries while in custody that would have rendered him immobile or unconscious. How could someone in that condition have "fallen"? Rather than interrogating eyewitnesses or the implicated MACC officers, the police blame our family. Is this reasonable?
4. MACC officers and security personnel colluded in false testimony
Their testimony were inconsistent across:
- The coroner's inquest
- Police investigations
- The Royal Commission of Inquiry
Both the Court of Appeal and RCI concluded MACC officers gave false testimony. Why haven't police arrested and charged them under relevant penal code provisions for false statements? What cooperation do you need from us - lessons on how to conduct investigations?
5. Have police answered the 10 critical questions we raised at our 24 February 2025 press conference at KLSCAH?
On 21 June 2018, the Cabinet agreed to reopen investigations including under Section 302 (Murder) per the Court of Appeal's judgment. On 1 August 2024, Prime Minister Anwar Ibrahim gave the same assurance . Yet no substantive action has been taken
Our request for international investigative experts was dismissed with claims of needing to "consult the IGP"

Given the police's erroneous application of Section 342 (Wrongful Confinement) which enabled MACC officers to evade accountability, we demand:
1. Immediate reopening of the case under Section 302 (Murder) as per the Court of Appeal's judgment
2. Arrest and detention of all implicated officers for proper interrogation

While we are appalled by the police's transition from confidence to claiming "lack of resources", we acknowledge their honesty about these shortcomings. We therefore call upon:
1. Prime Minister Anwar and the government to intervene immediately
2. Correction of the wrongful application of Section 342, by applying Section 302 (Murder) of the Penal Code to reopen the investigation.
3. Allocation of adequate resources and engagement of internationally renowned investigators

Ng Yap Hwa says the police’s refusal to rigorously investigate MACC in Teoh Beng Hock’s death is likely a result of ‘mutual protection’ among officials and law enforcement agencies.
Teoh Beng Hock Association for Democratic Advancement chairman Ng Yap Hwa said the police should not have shifted the blame for their lack of progress in a probe into Beng Hock’s death onto Teoh’s family.
PETALING JAYA: The Teoh Beng Hock Association for Democratic Advancement (TBH-ADA) has demanded that the police provide a detailed account of which Malaysian Anti-Corruption Commission officers they have questioned as part of its reinvestigation into Teoh’s death.
Teoh was found dead while being investigated by MACC officers in 2009. While a coroner’s inquest in 2011 delivered an open verdict, the Court of Appeal set it aside and ruled the death was caused by multiple injuries as a result of unlawful acts by unknown persons – which included MACC officers.
Last November, the Kuala Lumpur High Court instructed the authorities to probe Teoh’s death again, with Bukit Aman criminal investigation department director Shuhaily Zain stating on Tuesday that the investigation was almost complete.
However, Shuhaily said the police have had limited resources to probe the case. Stating that there were several witnesses the police were unable to interview again, Shuhaily also claimed that Teoh’s family had not provided their full cooperation.
In a statement, TBH-ADA chairman Ng Yap Hwa said Shuhaily’s statement was unconvincing and lacked credibility, adding that the CID chief should not have shifted the blame for the lack of progress onto Teoh’s family.
“Such politician-like excuses demonstrate the police’s lack of professional competence in handling the case,” said Ng.
“Our association has repeatedly submitted the Court of Appeal’s judgment to police investigators, emphasising that the judgment stated that ‘one or more unknown persons, including MACC officers, caused his death’.
“I submitted a list of 34 MACC officials involved in Teoh’s 2009 death to the police in February. The police must now disclose which of these MACC officers could not be located or refused to cooperate with the investigation.”
In July 2009, Teoh, who was then the political aide to Selangor executive councillor Ean Yong Hian Wah, was found dead on the fifth floor of Plaza Masalam in Shah Alam, hours after he had gone for questioning at the 14th floor of MACC’s Selangor headquarters.
In the statement, Ng also claimed that the police’s refusal to rigorously investigate MACC is likely a result of “mutual protection” among officials and law enforcement agencies.
“The police’s attitude shows that they never seriously studied the Court of Appeal’s judgment, disobeying Prime Minister Anwar Ibrahim’s promise to the Teoh family,” said Ng.
Last August, Anwar rejected a request by Teoh’s family to invite international criminal investigation experts to Malaysia to conduct a fair, professional and transparent investigation into the case, stating that Malaysian police were capable of probing the matter.
Ng today repeated the call for a probe into Teoh’s death to be led by international experts, stating that Anwar’s directive to let the police investigate the matter has “failed to uncover the truth or bring the culprits to justice”.
He said that despite Teoh’s death occurring in a protected area in the Selangor MACC headquarters with injuries on his neck sustained before his fall, and the Court of Appeal identifying MACC officials as potential suspects in his death, the police had focussed their investigation on Teoh’s siblings.
Ng said Teoh’s brother was hundreds of kilometres away from the Selangor MACC headquarters at the time of Teoh’s death and his sister was 20km away.
“This defies all logic and is utterly absurd!” said Ng.

The police are probing Teoh Beng Hock’s 2009 death again following an order from the Kuala Lumpur High Court.
Bukit Aman CID director Shuhaily Zain said the police had a hard time reaching out to Teoh Beng Hock’s family members to assist in their probe.
PETALING JAYA: Teoh Beng Hock’s family has not fully cooperated with the police in their new probe into the former political aide’s death, says Bukit Aman criminal investigation department director Shuhaily Zain.
At a press conference today, Shuhaily said the police are in the final stages of reinvestigating Teoh’s death, with the investigation paper to be submitted to the deputy public prosecutor (DPP) soon.
However, Shuhaily said the police had been having a hard time reaching out to Teoh’s family members to assist in the probe.
“The family did not cooperate with us to help finalise the investigation papers,” he said in a Berita Harian report, adding that the DPP would be informed about the matter.
In July 2009, Teoh, who was then the political aide to Selangor executive councillor Ean Yong Hian Wah, was found dead on the fifth floor of Plaza Masalam in Shah Alam, hours after he had gone for questioning at the 14th floor of the Malaysian Anti-Corruption Commission’s Selangor headquarters.
A coroner’s inquest in 2011 delivered an open verdict.
Teoh’s family subsequently filed an appeal against the findings, and three years later, the Court of Appeal set aside the open verdict and ruled the death was caused by multiple injuries as a result of unlawful acts by unknown persons.
Last November, the Kuala Lumpur High Court instructed the authorities to reopen and thoroughly reinvestigate all aspects of Teoh’s death.
Stating that the police had limited resources to probe the case as Teoh died 15 years ago, Shuhaily noted that there were several witnesses the police were unable to interview again.
He also stated that the use of 3D scanning technology to reconstruct the scene of the incident did not significantly aid the police in their investigation.
“The 3D scan could not provide a complete picture of what actually happened as witnesses could not be found and others were unwilling to come forward again, which limited the effectiveness of the 3D reconstruction,” he said.
However, he noted that there were still some findings that could contribute to the investigation. He revealed that the police had determined the angle of Teoh’s fall – which would be included in the investigation paper.
Earlier this year, the Teoh Beng Hock Association for Democratic Advancement called on the police to accept a demand by Teoh’s family for an international criminal investigation expert to lead the new probe into his death.
The association’s chairman, Ng Yap Hwa, stressed that the police must conduct an independent and professional investigation and probe all possible angles.
He also said the police must investigate the five key MACC officers involved in the incident for murder and culpable homicide.
