SEPANG: The sessions court here has slapped activist Jufazli Shi Ahmad with a RM20,000 fine for the improper use of network facilities and disparaging the judiciary in a video three years ago.

Sessions court judge Ahmad Fuad Othman said the prosecution had proven its case beyond a reasonable doubt.

Jufazli, 35, who was the sole defence witness, chose to give an unsworn statement from the dock. He denied being the individual in the video and the one who uploaded it.

Deputy public prosecutor Raja Zaizul Faridah Raja Zaharudin pressed for a jail term to serve as a deterrent to other would-be offenders.

Lawyer M Visvanathan however argued that a fine would suffice, as a prosecution witness had testified during cross-examination that Jufazli’s actions did not lead to social unrest or disrupt the judiciary’s operations.

Fuad said he would only impose a fine as the offence committed by the accused had “some impact” on the judiciary but not as serious an effect as by those who played up 3R (religious, race and royalty) issues.

Jufazli was accused of uploading a 20-minute video titled “Hakim Kes 1MDB diugut oleh Najib Razak dalam Mahkamah Malaysia!?!?” on Jan 22, 2021. The video was seen the following day at a location in Cyberjaya.

The Sabahan, who now lives in Cheras, was said to have improperly used network facilities under Section 233(1)(a) of the Communications and Multimedia Act 1998. The provision provides for a fine of up to RM50,000, a maximum of one year in jail, or both, upon conviction.

Jufazli paid the fine.

Visvanathan, who was assisted by V Sanjay and V Pushan, said he had his client’s instructions to file an appeal. - FMT
