Prosecutors file appeal against acquittal of Rosmah ‘Fat Mama’ Mansor
KUALA LUMPUR, Dec 20, 2024: The prosecution today filed an appeal with the Court of Appeal seeking to reverse super rich Rosmah “Fat Mama” Mansor’s acquittal from 17 money laundering and tax evasion charges without a trial.
The notice of appeal was filed with the High Court registry here this afternoon, well ahead of a 14-day deadline.
Deputy public prosecutor Ahmad Akram Gharib confirmed the filing when contacted by FMT.
Fat Mama is wife of the diragraced and shameless former prime min ister, Najib “1MDB” Razak, who is serving his jail sentence in Kajang Prison as well as facing 25 charges of power abuse and money laundering involving RM2.27 billion.

KUALA LUMPUR: The prosecution has filed an appeal to the Court of Appeal seeking to reverse Rosmah Mansor’s acquittal from 17 money laundering and tax evasion charges without a trial.
The notice of appeal was filed at the High Court registry here this afternoon, well ahead of a 14-day deadline.
Deputy public prosecutor Ahmad Akram Gharib confirmed the filing when contacted by FMT.
The High Court registry will now be required to prepare the appeal records, which must include a written judgment issued by the judge.
The prosecution will then submit a petition of appeal to state where the judge erred in law and on the facts.
On Wednesday, High Court judge K Muniandy ruled that the charges brought against Rosmah, wife of former prime minister Najib Razak, were illegal and flawed as they did not comply with provisions in the Criminal Procedure Code.
“The charges amounted to duplicity and multiplicity. Furthermore, they did not disclose any offence,” he said.
Muniandy said the money laundering charges were defective as they only revealed that Rosmah had deposited money into her account at Affin Bank Bhd.
“Merely depositing money is not tantamount to indulging in unlawful activities and committing money laundering offences,” he said.
He also said the five tax evasion charges brought under the Income Tax Act 1967 were premature as Rosmah’s appeal on the tax assessment was still pending before the Special Commissioners of Income Tax.
“They must first determine the amount of tax she should pay to the Inland Revenue Board and, if dissatisfied, she also has the avenue of judicial review,” he said.
Rosmah, 73, was standing trial on 12 money laundering charges involving RM7.09 million and five charges of failing to declare her income to the Inland Revenue Board.
She was accused of committing the offences between Dec 4, 2013 and June 8, 2017, and was charged on Oct 4, 2018.
The trial began on Aug 24 last year with two prosecution witnesses taking the stand. It stalled two weeks later after Rosmah filed her striking-out application on Sept 6.

KUALA LUMPUR, Dec 19, 2024: Although super rich Rosmah “Fat Mama” Mansor was acquitted of 12 money laundering charges involving RM7.09 million, her worries are far from over,
High Court Justice K. Muniandy today also freed her of five charges of failing to declare her income to the Inland Revenue Board (IRB).
However, the acquittals were due to technicalities and the prosecutors have vowed to appeal Justice Muniandy’s decision.
The wife of the disgraced and shameless former prime minister, Najib “1MDB” Razak, is also waiting for her appeal before the Court of Appeal to be heard over her conviction in the RM1.25 billion corruption case on a solar energy project for rural schools in Sarawak.
In September 2022, Rosmah was jailed 10 years by the High Court and fined RM970 million for corruption in connection with the RM1.25 billion project.
And today was also the first case management under a new judge in the US$346 million (RM1.56 billion) lawsuit filed by 1Malaysia Development Berhad (1MDB) and 10 other companies against Fat Mama, accusing her of using misappropriated 1MDB funds to purchase luxury goods.

PETALING JAYA: The US$346 million lawsuit filed by 1MDB and 10 other companies against Rosmah Mansor, accusing her of using misappropriated 1MDB funds to purchase luxury goods, is now under the jurisdiction of High Court judge Wan Amin Wan Yahya.
This was confirmed by lawyer Villasha Anbalagan, who represented all the plaintiffs in proceedings today, Bernama reported.
“Today saw the first case management before the new judge (Wan Amin).
“The court has fixed Feb 7 for the parties to provide an update of the status of the suit,” she said in a WhatsApp message following proceedings conducted via Zoom.
Last month, High Court judge Leong Wai Hong, a former partner at Skrine, granted Rosmah’s application and recused himself from presiding over the lawsuit, citing his past connection with the law firm.
Rosmah’s recusal application had raised concerns of a conflict of interests, as Skrine is representing 1MDB in a civil suit filed against her husband, former prime minister Najib Razak, and several 1MDB officials.
Before Leong, the case had been presided over by Justice Adlin Abdul Majid, who dismissed Rosmah’s initial recusal application on Sept 9, on grounds that there was no real danger of bias.
Adlin was later transferred to the intellectual property division, which led to Leong taking over the case.
The lawsuit, filed on May 9, involves 1MDB and its five subsidiaries – 1MDB Energy Holdings Ltd, 1MDB Energy Ltd, 1MDB Energy (Langat) Ltd, Global Diversified Investment Company Ltd, and SRC International Sdn Bhd.
The five other companies involved are Affinity Equity International Partners Ltd, Alsen Chance Holdings Ltd, Blackrock Commodities (Global) Ltd, Blackstone Asia Real Estate Partners Ltd, and Brightstone Jewellery Ltd.
The plaintiffs have named Rosmah and a woman identified as Shabnam Naraindas Daswani, also known as Natasha Mirpuri, as the first and second defendants, respectively.
They are seeking a court order for Rosmah to pay US$346,010,489 (RM1.56 billion) or an amount deemed appropriate by the court.
The plaintiffs are also seeking declarations that the first to sixth plaintiffs are the rightful owners of the luxury items, which are purportedly in Rosmah’s possession.

KUALA LUMPUR, Dec 19, 2024: The super rich wife of disgraced and shameless former prime minister, Najib “1MDB” Razak, Rosmah Mansor was today acquitted of 12 money laundering charges involving RM7.09 million.
The High Court ruled that the charges were illegal and flawed as they did not comply with provisions in the Criminal Procedure Code (CPC).
Justice K. Muniandy also freed her of five charges of failing to declare her income to the Inland Revenue Board (IRB).
However, “Fat Mama” Rosmah is still appealing before the Court of Appeal over her conviction in the RM1.25 billion corruption case on a solar energy project for rural schools in Sarawak.
In September 2022, she was jailed 10 years and fined RM970 million for corruption in connection with the RM1.25 billion project.

KUALA LUMPUR: Rosmah Mansor said that the High Court’s decision to free her of 17 money laundering and tax evasion charges today was a belated birthday gift for her.
Rosmah, the wife of former prime minister Najib Razak, turned 73 on Dec 10.
“The court’s decision is a special birthday present for me,” she told reporters at the court compound today.
“I will relay this good message to my husband. This is the justice I was waiting for.”
Rosmah was standing trial on 12 money laundering charges involving RM7.09 million and five charges of failing to declare her income to the Inland Revenue Board.
Justice K Muniandy had allowed her application to have all of the charges against her quashed.
He said the charges were illegal and flawed as they did not comply with provisions in the Criminal Procedure Code.
Rosmah still has an appeal pending before the Court of Appeal over her conviction in the RM1.25 billion corruption case on a solar energy project for rural schools in Sarawak.
In September 2022, she was sentenced to 10 years in jail and fined RM970 million after being found guilty of corruption in connection with the RM1.25 billion project.
