PETALING JAYA: The MACC is acting unlawfully by forcing arrested persons to wear orange lock-up uniforms, PKR's N. Surendran said today. Referring to the two recent highly publicised arrests by the MACC of Penang Exco Phee Boon Poh(pix) and Tan Sri Isa Samad, he said they shouldn't have been brought to court in the lock-up uniforms. "The MACC's practice of making arrested persons wear lock-up uniforms is in breach of the principle that a person is innocent until proven guilty," said Surendran, who is Padang Serai MP. "The practice is hence unlawful, as well as being in breach of Article 5 of the federal constitution. "An arrested person under investigation must be allowed to wear his own clothes, and not any kind of uniform issued by the enforcement authority that has arrested him. Many Malaysians are wondering why the Malaysian Anti-Corruption Commission (MACC) has yet to have disgraced former premier Najib Razak wear its orange lock-up clothes.

From the electronic social media networks, the MACC must be “feeling the heat” for not doing so. If not, why did deputy chief commissioner (operations) Azam Baki tried to explain or justify not having Najib clad in the orange garb or handcuffed.

Unfortunately, Azam’s explanation was not only lame, it borders on insulting the intelligence of Malaysians in general.

Azam said one of the main considerations taken into account was the possibility of the detainee escaping by blending into a crowd.

"In ordinary circumstances, if the person is deemed to be a potential risk, they will be made to wear the orange uniform … on a case-by-case basis.

So, Shafie Apdal (now Sabah Chief Minister) and many other then Opposition politicians were at risk of fleeing from detention?

Azam and MACC should just raise their work rate and standard of investigations to have the thousands of corrupt locked up in jails.

Stop wasting time and energy in defending the ways of the corrupt-to-the-core former Barisan Nasional (BN) federal administration.

Malaysians don’t want to hear crap explanations from MACC. Just work diligently and treat every case fairly, without fear or favour.

KUALA LUMPUR: Whether detainees wear the orange-coloured lock-up attire is at the discretion of the investigation officer and is not mandatory, explained Malaysian Anti-Corruption Commission (MACC) deputy chief commissioner (operations) Datuk Seri Azam Baki (pic left).

He said in an interview aired on the Bernama radio channel Saturday morning (Sept 22) when asked why former prime minister Datuk Seri Najib Tun Razak was not in handcuffs and wearing orange-coloured lock-up attire when he was charged at the Kuala Lumpur courthouse with four graft and 21 money-laundering charges on Thursday (Sept 20).

Azam said one of the main considerations taken into account was the possibility of the detainee escaping by blending into a crowd.

Bernama quoted him as saying that there were many other politicians who were not made to wear the orange garb nor were they handcuffed.

On Thursday, Najib pleaded not guilty in the Kuala Lumpur Sessions Court over 25 charges of corruption and money laundering.

MACC panned for dressing Isa Samad, Penang exco as prisoners

KUALA LUMPUR, Aug 17 — The Malaysian Anti-Corruption Commission (MACC) violated rights and procedures by dressing Tan Sri Isa Samad and a Penang lawmaker as detainees when presenting them in court, said a federal lawmaker. PKR's N. Surendran said accused individuals have the right to wear their own clothes while they remain on trial, and forcing them to publicly don attire reserved for prisoners was prejudicial to them. “Being forced to wear these bright orange uniforms and being paraded thus in the court premises is humiliating to the arrested person and creates the perception that he is indeed a wrongdoer or criminal, even though the court has not pronounced guilt,” he said.
