Bigoted man denies slapping undergraduate for eating in public

KUALA LUMPUR, March 19, 2025: The 65-year-old racial and religious bigoted Malay man has changed his guilty plea and claimed trial in a magistrate’s court to slapping a Chinese university undergraduate for eating in public during the current fasting month.

Abdul Razak Ismail, a government retiree, had pleaded guilty earlier today before disputing the facts of the charge.

This afternoon, Ismail claimed trial to a fresh charge of slapping a non-Muslim man for eating in public during Ramadan.

PETALING JAYA: A senior citizen has claimed trial to a fresh charge of slapping a non-Muslim man for eating in public during Ramadan.

Abdul Razak Ismail, 65, pleaded not guilty after the charge was read out in the Johor Bahru magistrates’ court today, Bernama reported.

Razak was charged with voluntarily causing hurt under Section 323 of the Penal Code, which provides for up to two years’ imprisonment, a maximum fine of RM2,000, or both, upon conviction.

He is accused of committing the offence at a shopping mall in Johor Bahru at 3.45pm on March 16.

Earlier, Razak pleaded guilty to the charge of voluntarily causing hurt before he disputed the facts of the case. This prompted magistrate A Shaarmini to reject the guilty plea and order that the case go to trial.

Before a trial date could be set, the prosecution requested a discharge not amounting to an acquittal (DNAA), saying they were ordered to refer the case to the Attorney-General’s Chambers (AGC).

The AGC later said the accused was given a DNAA as a technical issue had arisen with the initial charge, adding that this has been resolved.

PRIME MINISTER Datuk Seri Anwar Ibrahim has urged for an immediate pause to any actions that undermine the spirit of unity and harmony in Malaysia, following a recent incident at a shopping centre in Johor Bharu.

The Prime Minister's comments come after an elderly man was accused of slapping a non-Muslim for eating in public during Ramadan at the Angsana Shopping Mall in Tampoi.

Speaking at a daily briefing from the Prime Minister’s Office, Tunku Nashrul Abaidah, the senior press secretary to Anwar, condemned the act, stating, "Any actions like this or similar must be stopped simply because it goes against the spirit of unity and harmony of the country."

He added: "What is the point of talking about Islam and its beauty, especially in the month of Ramadan, if it does not build internal strength and keep us away from violent attitudes that threaten peace and harmony?"

The Prime Minister’s office also stressed the importance of mutual respect in maintaining peace across Malaysia.

Tunku Nashrul said the Prime Minister believes that sensitive issues involving race, religion, and national unity can be avoided if all Malaysians remain committed to upholding mutual respect to build a more civilised and harmonious nation.

The incident unfolded last Sunday when a video circulated on the social media platform X (formerly Twitter), showing a confrontation between the elderly man and the non-Muslim individual.

The elderly man reportedly reprimanded the other for allegedly eating in public during the holy month of Ramadan, a time when Muslims fast during daylight hours.

The situation escalated when the senior citizen demanded the non-Muslim individual show his MyKad, Malaysia's identity card, to confirm he was not Muslim.

In the footage, tensions heightened when the non-Muslim man refused to show his identification card, and the elderly man subsequently slapped him several times. The incident sparked outrage and public concern over the behaviour displayed.

The matter was brought before the courts today, where the elderly man was granted a discharge not amounting to an acquittal (DNAA).

This decision was made following an order from the Attorney General’s Chambers, which instructed that the case be referred back for further review.

The episode has led to widespread debates regarding respect for religious practices and public conduct during Ramadan in a multicultural society like Malaysia.

PMO: Be vigilant against "slander"

The Government is closely monitoring what it describes as a campaign of "continuous slander" against Anwar.

While Tunku Nashrul did not specify the nature of the alleged slander, he emphasised that the government was taking the matter seriously.

He characterised the attempts as a sign of "desperation" from certain groups attempting to manipulate public opinion, suggesting that these groups lack substantive ideas for national development.

"Spreading slander, especially during Ramadan, is the lowest form of conduct and is strongly prohibited in Islam," stated Tunku Nashrul.

"However, we will continue to closely monitor the situation to ensure that it never threatens or weakens our spirit and determination in safeguarding the nation and the people's well-being," he added. – March 19, 2025

The Attorney-General’s Chambers says Abdul Razak Ismail was granted a discharge not amounting to an acquittal earlier today due to a technical issue.

PETALING JAYA: The senior citizen who allegedly slapped a non-Muslim for eating in public during Ramadan will be re-charged this afternoon.

The Attorney-General’s Chambers (AGC) said a technical issue had arisen with the initial charge filed against Abdul Razak Ismail, 65, this morning.

“This issue has been resolved and the individual will be re-charged at the Johor Bahru magistrates’ court this afternoon,” it said in a statement today.

“The AGC remains committed to ensuring that justice is served in accordance with the provisions of the law.”

The AGC also said it deemed the prosecution against the man to be appropriate.

Earlier today, the Johor Bahru magistrates’ court granted Razak a discharge not amounting to an acquittal (DNAA).

He had pleaded guilty to a charge of voluntarily causing hurt to a man at a shopping mall in Johor Bahru on March 16, but later disputed the facts of the case.

This prompted magistrate A Shaarmini to reject the guilty plea and order the case to go to trial.

However, before a trial date could be set, deputy public prosecutor Nur Fatihah Nizam requested for a DNAA as the prosecution had been ordered to refer the case to the AGC.

Previously, the victim said on X that he was having a meal at a convenience store in a Johor Bahru shopping mall when a man asked him if he was Chinese.

When he replied that he was, the man demanded to see his MyKad. He claimed that after he refused to do so, the man became angry and slapped him several times.

The man’s son then defused the situation and apologised on his behalf. The victim said he accepted the apology by the man’s son, but still needed to make a police report as it was a physical assault in a public place.

Magistrate A. Shaarmini then granted the DNAA (Discharge Not Amounting Acquittal) at the request of deputy public prosecutor Nur Fatihah Nizam.

Shaarmini granted the DNAA pending the fresh charge against Abdul Razak Ismail, 65, Kosmo reported.

PETALING JAYA: A senior citizen who allegedly slapped a non-Muslim man for eating in public during Ramadan has been granted a discharge not amounting to acquittal (DNAA) by the Johor Bahru magistrates’ court today.

Magistrate A Shaarmini granted the DNAA at the request of deputy public prosecutor Nur Fatihah Nizam, who said they were ordered to refer the case to the Attorney-General’s Chambers.

Shaarmini granted the DNAA pending the fresh charge against Abdul Razak Ismail, 65, Kosmo reported.

Earlier, Razak was slapped with a charge of voluntarily causing hurt. He initially pleaded guilty but later disputed the case facts read out to the court.

Shaarmini then rejected his guilty plea and ordered him to enter his defence.

Before a trial date could be set, the prosecution requested the DNAA.

Razak was charged with committing the offence at a shopping mall in Johor Bahru at 3.45pm on March 16.

The offence of voluntarily causing hurt, framed under Section 323 of the Penal Code, is punishable with up to two years’ imprisonment, a maximum fine of RM2,000, or both, upon conviction.
