 Supreme Commander vs NSC-powered 1MDB PM Najib; who will the Chief Of Defence Forces obey?

Yes! The new National Security Council Act 2016 (NSC) may have made 1Malaysia Development Berhad (1MDB) Prime Minister Najib Razak appear all Almighty and untouchable.

As what Dr Mahathir Mohamad, who reigned as Malaysia’s prime minister for 22 years, had posted in his blog chedet.cc, the NSC has made Najib a dictator.

However, there is still the question of the position of the Supreme Commander of the Armed Forces or the Commander-in-Chief of the Armed Forces.

And the Supreme Commander is the Yang di-Pertuan Agong (King).

In a hypothetical scene, when the Chief Of Defence Forces receives conflicting instructions from his Supreme Commander and Najib … who will he obey?

This is surely a gray area in the separation of powers as a result of the NSC, and one that has yet to be tested.

This is what was posted by the Malaysian-banned online news portal Malaysia Chronicle, on the position of the Yang di-Pertuan Agong as the Supreme Commander of the Armed Forces and the NSC-powered PM Najib:

NSC Act pits Chief Of Defence Forces against his Commander In Chief, The Agong. Might the Agong order the CDF be court-martialled?

Malaysia’s National Security Act 2016 came into force on 1 August 2016 ,without royal assent.

While royal assent is deemed to have been granted ,it remains a fact that the Agong withheld assent.
The Act allows the Prime Minister Najib to call out the troops to enforce his will against the civilian population.

Chief Of Defence Forces (CDF), Gen Tan Sri Zulkifeli Mohd Zin acting on the orders of the Prime Minister would be person in charge of operations if and when PM Najib calls out the troops. However, he is also subject to the authority of the King, the Yang DiPertuan Agong,who is the Commander In Chief or Supreme Commander of the Armed Forces.

The loyalty of the Chief Of Armed Forces and indeed any soldier to the Agong, his Supreme Commander is seldom if ever in conflict with their loyalty to the government of the day given the norms and conventions of the system of constitutional monarchy.

However ,once those norms and conventions are breached or ignored expect the unexpected, such as the case now where the Chief Of Defence Forces may well be in a position where obeying the prime minister means defying the will of his Supreme Commander.

The hypothetical consequences are many , and wholly unpredictable. The Agong could perhaps order the arrest and court-martial of the CDF, if the Agong decides that the people are being oppressed or otherwise harmed by the armed forces. He may choose to communicate directly with the defence chiefs ie the chiefs of army,navy and air force,requesting that they not cooperate with the CDF. He may well appeal directly to the troops.

At the end of the day, the Agong is the Supreme Commander and monarch, who retains untested reserved powers.

Convention provides that the Agong only act as advised, but similarly convention also requires that the powers of the Agong, be never challenged. There is good reason for this,for the Agong and his fellow rulers have untested reserved powers which again, by convention, are never tested.

Convention is a strange creature and dependent on the norms and practices of the ruler and his people. Given the context of the Malay-Muslim culture from which the Agong and his brother rulers draw their powers, it would be very unwise for anyone to try and determine the limits of those powers.


The deeming provisions which provide that any bill passed by parliament becomes law regardless of whether royal assent is granted were written into the Constitution as a matter of political expediency with little thought for the issues that could arise given the underlying assumption of a monarch or supreme ruler, even if his power is not absolute. In formulating the NSC Act PM Najib and his government have managed to raise one such issue, the likely break in the chain of command in the armed forces,given that the Agong is Supreme Commander. As the Defender Of The Faith, there is no telling what he may find himself having to do if the armed forces are used against his people.

NEW YORK: Taking into account the severity of the threats to national security and defence, the Malaysian government has appointed a military officer as the Director-General of the National Security Council, it was announced here Wednesday.

Malaysian Deputy Prime Minister and Home Minister Datuk Seri Dr Ahmad Zahid Hamidi, who made the announcement, said Chief of Defence Forces Gen Tan Sri Zulkifeli Mohd Zin has been appointed the first Director-General of the council.

It is learnt that Zulkifeli’s appointment took effect on Aug 15. Up to now the council had a civilian occupying the post of secretary.

“In view of the threats to national security and defence, the government decided that a police or military officer should be in charge of the council,” Ahmad Zahid said at a dinner with officers and staff of the Malaysian Permanent Mission to the United Nations and government agencies operating in New York, at the mission office here.

He also said that more police and military officers with experience in national security and defence matters would be appointed to the council.

Ahmad Zahid also urged Malaysians not to take lightly the domestic and external threats to national security and defence.

He said Zulkifeli’s appointment was a move to strengthen the National Security Council to be like the council in the United States.

He advised the people to view the matter positively and not to underestimate the threats to the country’s security and defence. The national security and defence policy was drawn up by combining the synergies of duties between the Royal Malaysia Police and the Malaysian Armed Forces, he said.

Ahmad Zahid said the people could have differences of opinion in politics and that this was encouraged, but in the matter of national security and defence, they must be united.

He said the people should not assume that terror attacks which occurred abroad would not take place in Malaysia.

“The question is when and where they could take place,” he said.

Ahmad Zahid also said that there existed a group that called itself “Khalifah Nusantara” which wanted to establish a so-called Islamic empire in the archipelago with its members active in Singapore, Malaysia, Indonesia and Brunei Darussalam.

He said the group was committing terror attacks in the region, and added that the bombing at the Movida nightclub in Puchong, Selangor, on June 28 was believed to be the first Daesh attack in Malaysia.

The people must be vigilant against further attacks and should not leave the task of preventing such occurrences only to the police and military.

“Some people are bent on pointing a finger at the security and defence forces whenever a terror attack occurs but in other countries the people back their police and military,” he said.

The task of maintaining security and defence should not be left to the police and military alone, he said, adding that the “Hanruh” total defence approach should be adopted that involved the people as well.

In this connection, he said, the Volunteer Smartphone Patrol team was launched on Aug 16 to help channel information on crime to a command centre for follow-up action to be taken.

This, he said, would be able to reduce dependence on the surveillance system through closed circuit television cameras to check crime in hotspots.

Ahmad Zahid said this approach mobilised the People’s Volunteer Corps (Rela), Civil Defence Corps, community policing and Rakan Cop (Friends of Police) involving five million people, with the initial participation of 5,000.

These “eyes and ears” of the security forces would use mobile phones to channel information real time to the command centre, he said. He urged the people to register as members of the team to help the police and military and not take for granted security and defence issues.

Ahmad Zahid said the formulating of the National Security Council Act 2015 was not intended to usurp the powers of the Yang di-Pertuan Agong as alleged by certain quarters.

The Act provided for the Prime Minister to be the chairman of the council not with the intention of empowering him to declare an emergency in the whole country but only in a specific area should there be a threat to national security and any threat from a foreign power, he said. The Act consolidated the National Security Council, he added.

Ahmad Zahid is in the United States on a five-day working visit beginning Aug 22.

He also chaired a United Nations Security Council high-level open debate on non-proliferation of weapons of mass destruction on Tuesday at the UN headquarters.

Malaysia is a non-permanent member of the Security Council from Jan 1 last year until the end of this year, and is holding the rotating presidency of the highest decision-making body of the UN for this month.

Ahmad Zahid’s wife Datin Seri Hamidah Khamis and Malaysia’s Permanent Representative to the United Nations Datuk Ramlan Ibrahim also attended the dinner. – Bernama

1. I was forced to read through the Constitution of Malaysia and the National Security Council Act 2016, in order to understand the need or otherwise of the power of the Yang di-Pertuan Agong and the Prime Minister in ensuring the security of the country.

2. I don’t think anyone would want to read through especially the National Security Council Act 2016. Still I feel a need to summarise the powers accorded the Prime Minister by comparison to the powers accorded the Yang di-Pertuan Agong.

3. While the powers of the Yang di-Pertuan Agong give due consideration to the rights and freedom of a citizen when he is to be detained, the power of the Prime Minister under the National Security Act is almost unlimited.

4. The action may be taken by the Director of Operations but the ultimate power rests with the Prime Minister as Chairman of the National Security Council.

5. For easy reading I list below the power of the Prime Minister:
I. Set up National Security Council
II. Chair the Council
III. Council advise the Prime Minister i.e. to himself
IV. Power to –
(a) Exclude and evacuate persons
(b) Declare Curfew
(c) Control movement, road, waterway, aircraft.
(d) Arrest persons
(e) Search and seize

6. The need to let the Yang di-Pertuan Agong decide on the declaration of Emergency is because the laws which protect citizens and ensure justice will be suspended when Emergency is declared. The rule of law will be ignored.

7. But now the power of the Yang di-Pertuan Agong has become superfluous. Najib as Chairman of the Council advising Najib as the Prime Minister will have the right to disregard the laws and exercise the powers listed above. Najib’s rights are far more numerous and superior by comparison with the rights and power of the Yang di-Pertuan Agong. There is no more need for reference or approval of the Yang di-Pertuan Agong. Najib as Chairman of the Council simply advises himself as the Prime Minister.

8. He can use “reasonable force” and dispense with any inquest should an enforcement officer or the person apprehended dies. He is fully protected against suits and legal proceedings. All proceedings of the Council will be official secret. No member of the Council may reveal anything, including apparently criminal acts committed.

9. This Act relegates the Constitution to the back burner. It is wrong of course. The Constitution, we all proudly declare is the Supreme Law of this great nation. But no one is going to do anything when it is breached. – http://chedet.cc/
