Political analyst Abdul Razak Baginda will object to Shaariibuu Setev’s amended statement of claim in the civil suit regarding the murder of Altantuya Shaariibuu.

His lawyer Kuan Chee Foo indicated to the Shah Alam High Court that they will file an affidavit-in-reply.

“We will file the affidavit soon,” Kuan told Malaysiakini when met today.

Senior federal counsel Tengku Intan Suraya Tengku Ismail, who is representing the government, the fourth defendant, said they would not be objecting to Shaariibuu’s application.

Lawyer Ramkarpal Singh informed that Justice Ahmad Nasfy Yasin said the court had fixed Dec 16 for the decision on the application by Shaariibuu.

Ramkarpal, who is also Bukit Gelugor MP, formally informed the court today that his law firm Karpal Singh & Co, had successfully handed the application to amend the statement of claim to second defendant Sirul Azhar Umar at the Villawood detention centre in Sydney.

“The application was handed to Sirul after the Foreign Ministry had, for the past year, not comeK back to us on whether it had served the papers,” he said.

“The application was handed by an international process server by the name of Clinton Portors, from Sydney by handing to Sirul personally on Sept 27. Clinton affirmed an affidavit of service dated Oct 14,” he said.

Ramkarpal also said he had informed Shaariibuu over this latest development via email.

All of them were met after case management before Justice Ahmad Nasfy in his chambers today.

Shaariibuu and Altantuya’s two sons had filed a RM100 million suit against Azilah Hadri, Sirul, Abdul Razak and the government in 2007 on Altantuya’s death.

It has been more than 10 years since the death of the Mongolian woman on top of a hill in a land clearing between 10.30pm on Oct 18 and 1am on Oct 19, 2006, near Puncak Alam, Shah Alam.

Ramkarpal said the application to amend the statement of claim had to be made following the Federal Court decision in January last year to convict Azilah and Sirul of murdering Altantuya. The court sentenced them to death.

Abdul Razak was acquitted without his defence called at the Shah Alam High Court. The prosecution did not appeal against his acquittal.

Sirul made his way to Australia before the Federal Court decision, after he and Azilah were acquitted by the Court of Appeal.
