Illegal immigrant jailed three years for stealing RM1, is it justified?
An illegal immigrant was jailed three years by a magistrate’s court in Sandakan for stealing RM1.

The Malaysian-banned online news portal Malaysia Chronicle has re-posted a malaysikini news report on the case with a headline that appears to give the impression that the sentence was too harsh.

However, No News Is Bad News opines that the sentencing is justified because the crime was committed by an illegal immigrant from the Philippines.

In Sabah, Sabahans are now facing serious social and economic woes arising from the influx of millions of illegal immigrants, many of whom have also been given citizenship.

And, even in Peninsular Malaysia, especially in Kuala Lumpur’s Chowkit and George Town (Penang), Malaysians are intimidated by the presence of both illegal and legal immigrants.

We , therefore, find it justified that crimes committed by illegal foreigners should be treated with “no mercy” and “sympathy”. In the first place, they should not even have come to Malaysia to intimidate the locals.

What if the illegal immigrant had killed some one during the crime?

The sentencing also serves as a deterrent to help check the influx of illegal immigrants.

However, if it is a Malaysian committing a petty crime to afford food to fill his empty stomach, then the sentencing is most unjustified.

The Sandakan Magistrate’s Court today slapped a foreigner with a three-year jail sentence for breaking into a restaurant and stealing RM1.

Abu Huraira Razak, 27, who pleaded guilty before Magistrate Faelly Jeffrey Lanjungan, was also ordered to pay a fine of RM5,000 or serve 12 months in prison.

The court also ordered that he be deported back to the Philippines upon completion of his sentence.

Abu Huraira, who was arrested on Sept 15 after committing the theft, had arrived in Malaysia illegally only three days earlier.

He had broken into a restaurant through the back door and stole a ornamental coin box from the counter, which only contained RM1.

A worker, who realised that someone had entered the premises, alerted the police. Abu Huraira was arrested as he attempted to flee the area.

According to Berita Harian, the magistrate ordered that Abu Huraira, who was unrepresented, serve his sentence from the time of arrest.

Abu Huraira was charged under Section 457 of the Penal Code, which deals with trespassing or housebreaking in order to commit an offence punishable with imprisonment.
